Question Title I have been told that to trade in Malta through a company structure, a foreigner will need a Maltese partner. Can you please advise?
The information above is incorrect.

There are already in Malta thousands of companies doing business here that are totally or partially owned by foreigners. This is something that the local authorities encourage since it brings in the all important foreign direct investment. In fact in 2005 Malta ranked among the top three countries in the world that was receiving such Foreign Direct Investment (when computed pro rata to the local population).

Having said this, there exist some industries that, till now are reserved for Maltese investors (NOW READ EU INVESTORS) - example property development and retail, either in whole or in part. This means that such companies need to have either 100% or a smaller portion of their ownership in Maltese hands.

As indicated above, since 1st May 2004 no discrimination against EU citizens can be made in Maltese laws and hence any trading activities previously reserved only for Maltese citizens were then opened also to all residents of EU member states.
