Q. Can the Maltese public register as players and play on e-gaming sites licenced in Malta?
A. There is nothing in the Gaming Act that prohibits the Maltese public from playing on sites licenced in Malta. Nor there exist any other law that makes such e-gaming by the Maltese public illegal.
However, this is more of a taxation issue. As the Malta Income tax refund system applies to profits generated outside of Malta, any profits made on Malta resident players will not qualify for such refund.
Till December 2006, even minute profits from a Malta resident player would have disqualified all profits from these refunds, but the Malta income tax laws were amended as from 1st January 2007, to make such refunds proportionate to their source of origin, i.e. retained the refund system on foreign generated profits without the total prohibition of the Maltese players.
